Terms of Use

The short version
  • Kozu suggests compositions and camera settings with AI. They are suggestions: always look around you and stay safe.
  • Your photos are yours. Only photograph people who are happy to be photographed.
  • Kozu Pro renews automatically until you cancel in your Apple ID settings, at least 24 hours before the period ends.

1. Agreement

These terms are an agreement between you and Ka Wai Tong ("Kozu", "we", "us"), the developer of the Kozu app. By using Kozu you accept them and our Privacy Policy. If you don't agree, don't use Kozu.

2. Who can use Kozu

You must be 18 or older. You're responsible for keeping your phone and your app account secure.

3. What Kozu does, and staying safe

Kozu reads the scene in front of your camera and suggests Frames: a composition, directions for you and your subject, camera settings and a Look. The suggestions are generated automatically and can be wrong or inappropriate for your situation. You decide whether to follow them.

  • Always check your surroundings. Never step into traffic, onto ledges, into water or onto private property for a shot, even if a direction seems to ask for it.
  • Follow local laws, venue rules and signs about photography.

4. Your photos and content

You own the photos you take with Kozu. To create Frames, you let us send a downscaled still of the camera view to our server and our AI provider and process it, as described in the Privacy Policy. This permission ends when the Scan is processed.

You're responsible for what you photograph and share. Respect other people: get their permission before photographing or posting them, and don't use Kozu to harass anyone, invade anyone's privacy or break the law.

5. Free Scans and fair use

Kozu includes a number of free Scans each week, and more with Kozu Pro, a pass or a Scan pack. "Unlimited" Scans on Kozu Pro are for normal personal use: we may limit automated, excessive or abusive use that affects the service for others. Free allowances, bonuses and referral rewards have no cash value and may change.

6. Kozu Pro, passes and Scan packs

  • Kozu Pro (yearly or monthly) is an auto-renewing subscription. It unlocks unlimited Scans within fair use, unlimited Refine, RAW capture and every Look. Payment is charged to your Apple ID when you confirm the purchase. The subscription renews automatically at the same price and for the same period unless you turn off auto-renew at least 24 hours before the current period ends; your account is charged for the renewal within the 24 hours before the period ends.
  • Free trial: if an offer includes a free trial, the subscription starts and you are charged when the trial ends, unless you cancel at least 24 hours before then. Any unused part of a free trial ends when you buy a subscription.
  • Manage or cancel in Settings → your name → Subscriptions on your iPhone (on Android, in Google Play → Payments & subscriptions). Deleting the app doesn't cancel a subscription.
  • 7-day pass: Kozu Pro benefits for 7 days from purchase. It doesn't renew.
  • Scan packs add Scans that don't expire. They are used after your free weekly Scans.
  • Prices are shown in the app before you buy, in your local currency, and may differ by country. We'll tell you before a subscription price changes, as the App Store requires.
  • Refunds are handled by Apple (or Google Play) under their policies. We can't issue refunds ourselves.

7. Referrals

Referral rewards are given when a friend you invite enters your code and completes their first Scan within the offer's terms. We may withhold rewards obtained by fake accounts or other abuse.

8. Things you must not do

  • Reverse engineer, resell, scrape or interfere with Kozu, its server or its AI service, or use it to build a competing service.
  • Get around allowances, limits or payments.
  • Use Kozu for anything unlawful, harmful, or that infringes others' rights.

9. Our rights

Kozu, including the app, its design, Looks, icons and the Frames it generates as part of the service, belongs to us or our licensors. We give you a personal, non-transferable licence to use the app under these terms. Photos you take stay yours.

10. Other services

Kozu relies on other companies' services (such as Apple, Google, Supabase and Discord). Their terms apply to your use of them, and we're not responsible for them.

11. Changes and availability

We keep improving Kozu, so features may change, and the service may sometimes be unavailable. We may update these terms; we will change the date above and tell you in the app before a significant change takes effect. If you keep using Kozu after that, the new terms apply.

12. Ending

You can stop using Kozu at any time. We may suspend or end your access if you break these terms. Sections 4, 9 and 13 to 16 continue to apply after that.

13. Disclaimers

Kozu is provided "as is". To the extent the law allows, we don't promise that it will be uninterrupted or error-free, or that its suggestions will fit your purpose, and we disclaim implied warranties. Nothing in these terms limits rights you have under consumer protection law that can't be limited.

14. Limitation of liability

To the extent the law allows, we're not liable for indirect or consequential loss, lost data or lost profits, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. This doesn't limit liability for death or personal injury caused by negligence, fraud, or anything else that can't be limited by law.

15. Apple

If you got Kozu from the App Store: these terms are between you and us, not Apple, and we, not Apple, are responsible for Kozu and its content. Apple's Licensed Application End User License Agreement also applies. Apple has no obligation to provide maintenance or support for Kozu. If Kozu fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the extent the law allows, Apple has no other warranty obligation. We, not Apple, are responsible for any claims about Kozu, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims. You confirm that you're not in a country subject to a US Government embargo or designated as supporting terrorism, and that you're not on a US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Law and disputes

These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have jurisdiction, unless the law of the country where you live gives you the right to bring a claim there or requires its own laws to apply.

1. 協議

2. 誰可以使用 Kozu

你必須年滿 18 歲。你需要自行保護手機和 App 帳號的安全。

3. Kozu 做什麼，以及安全須知

Kozu 會讀取相機前的場景並建議構圖：包括畫面安排、給你和被拍者的指引、相機設定和風格。這些建議由系統自動產生，可能有誤，也可能不適合你的情況。要不要照做，由你決定。

  • 請隨時注意周遭環境。不要為了拍照走進車道、站上邊緣、走進水裡或進入私人土地，即使指引看起來是這樣建議。
  • 請遵守當地法律、場地規定和與拍照有關的告示。

4. 你的照片和內容

你用 Kozu 拍的照片屬於你。為了設計構圖，你同意我們依隱私權政策所述，把一張縮小的相機畫面傳到我們的伺服器和 AI 供應商並進行處理。這項同意在該次掃描處理完成後即結束。

你要為自己拍攝和分享的內容負責。請尊重他人：拍攝或張貼別人之前先取得同意，也不要用 Kozu 騷擾他人、侵犯他人隱私或違反法律。

5. 免費掃描和合理使用

Kozu 每週提供一定次數的免費掃描；使用 Kozu Pro、暢拍方案或掃描次數包可以獲得更多次數。Kozu Pro 的「無限」掃描適用於一般個人使用：如果自動化、過量或濫用的行為影響到其他人使用服務，我們可能加以限制。免費額度、加碼和邀請獎勵沒有現金價值，內容可能調整。

6. Kozu Pro、暢拍方案和掃描次數包

  • Kozu Pro（年方案或月方案）是自動續訂的訂閱，提供合理使用範圍內的無限掃描、無限重新構圖、RAW 拍攝和所有風格。你確認購買時，費用會從你的 Apple ID 扣款。除非你在本期結束至少 24 小時前關閉自動續訂，否則訂閱會以相同價格和期間自動續訂；續訂費用會在本期結束前 24 小時內扣款。
  • 免費試用：如果方案包含免費試用，試用結束時訂閱就會開始並扣款，除非你在試用結束至少 24 小時前取消。購買訂閱時，免費試用中未使用的部分即告失效。
  • 管理或取消訂閱：在 iPhone 的「設定」→ 你的名字 →「訂閱項目」（Android 請到 Google Play →「付款和訂閱」）。刪除 App 並不會取消訂閱。
  • 7 天暢拍：購買後 7 天內享有 Kozu Pro 的權益，不會續訂。
  • 掃描次數包：增加的掃描次數永不過期，會在每週免費掃描用完後使用。
  • 價格：購買前會在 App 中以當地貨幣顯示，不同國家或地區可能不同。訂閱價格變動前，我們會依 App Store 的規定先通知你。
  • 退款：由 Apple（或 Google Play）依其政策處理，我們無法自行退款。

7. 邀請好友

你邀請的朋友輸入你的邀請碼，並在活動條件內完成第一次掃描後，才會發放邀請獎勵。透過假帳號或其他濫用方式取得的獎勵，我們可以不予發放。

8. 禁止行為

  • 對 Kozu、其伺服器或 AI 服務進行逆向工程、轉售、抓取資料或干擾運作，或用它打造競爭服務。
  • 規避額度、限制或付款。
  • 把 Kozu 用於任何違法、有害或侵害他人權利的用途。

9. 我們的權利

Kozu（包括 App、設計、風格、圖示，以及服務產生的構圖）屬於我們或我們的授權方。我們授予你個人、不可轉讓的授權，讓你依本條款使用 App。你拍的照片仍然屬於你。

10. 其他服務

Kozu 需要使用其他公司的服務（例如 Apple、Google、Supabase 和 Discord）。你使用這些服務時適用它們的條款，我們不為它們負責。

11. 變更和服務可用性

我們會持續改善 Kozu，所以功能可能改變，服務也可能偶爾無法使用。我們可能更新本條款：會更新上方的日期，並在重大變更生效前先在 App 裡通知你。之後你繼續使用 Kozu，即適用新條款。

12. 終止

你隨時可以停止使用 Kozu。如果你違反本條款，我們可以暫停或終止你的使用權。終止後，第 4、9 條和第 13 至 16 條仍然適用。

13. 免責聲明

Kozu 依「現況」提供。在法律允許的範圍內，我們不保證服務不中斷、沒有錯誤，也不保證建議符合你的用途，並排除默示擔保。本條款不會限制你依消費者保護法享有、且不得限制的權利。

14. 責任限制

在法律允許的範圍內，我們不對間接或衍生損失、資料遺失或利潤損失負責；我們對你的全部責任，以你在求償前 12 個月內支付給我們的金額為上限。因過失造成的死亡或人身傷害、詐欺，以及其他依法不得限制的責任，不在此限。

15. 關於 Apple

如果你是從 App Store 取得 Kozu：本條款是你與我們之間的協議，不是與 Apple 之間的協議；負責 Kozu 和其內容的是我們，不是 Apple。Apple 的授權應用程式最終使用者授權協議也同樣適用。Apple 沒有義務為 Kozu 提供維護或支援。如果 Kozu 不符合任何適用的擔保，你可以通知 Apple，Apple 會退還購買價格（如有）；在法律允許的範圍內，Apple 沒有其他擔保責任。任何與 Kozu 有關的求償，包括產品責任、法規遵循、消費者保護和智慧財產權的主張，都由我們負責，而不是 Apple。你確認你不在受美國政府禁運或被列為支持恐怖主義的國家，也不在美國政府的禁止或限制對象名單上。Apple 及其子公司是本條款的第三方受益人，可以對你執行本條款。

16. 準據法和爭議

本條款以香港特別行政區法律為準據法，並由香港法院管轄；但如果你居住地的法律賦予你在當地提出求償的權利，或要求適用當地法律，則依其規定。
